Absolutely true, but the poll asks who's more to blame, not which one should be absolved of sin, you know? I totally agree that Harry was trying to hurt Draco...badly. But Draco was casting an Unforgiveable, and despite the regularity with which they seem to be flung around in the books, Unforgiveables are...Unforgiveable (unlike a spell created by a nasty, greasy kid with a grudge.)
